To date, Georgia has had ten constitutions. The present constitution took effect in 1983 and is the basic framework for Georgia government. Laws passed by the state government are second only to the United States Constitution. The constitution is broadly classified into the executive, legislative and judiciary branches.

The judiciary branch deals with the three kinds of courts, the limited jurisdiction courts, general jurisdiction court and the appellate jurisdiction courts, and deals with all other matters pertaining to the law.

The judges in these courts are selected through elections; however, the judges of the general jurisdiction court and the appellate courts are selected on a non-member basis. A district attorney elected for a term of four years by a general election heads each judicial network in the state.

Georgian limited jurisdiction courts are broadly classified further into four categories: juvenile courts, magistrate courts, probate courts and the state courts for the counties. One interesting thing about the state of Georgia is that each of the counties in the state has one of these courts, along with a state county court, and the final decision is made by judges rather than by a jury.

All the general trial cases are filed in the general jurisdiction court, which is the superior court. This is a regular court wherein the jury passes a verdict after hearing the case. The judge’s decision usually depends on the jury’s final verdict.

Appellate jurisdiction courts are of two kinds, the Court of Appeal and the Supreme Court. An appeal can be placed in the appellate courts if the judgment orders passed by either the limited jurisdiction or the general jurisdiction court judges do not satisfy the losing party, and they wish to raise certain issues about the final verdict in front of a higher authority. The Supreme Court is the highest reigning body, consisting of seven justices. It takes care of the state laws or election-related appeals while the Court of Appeals is used to handle the rest of the appeal cases.

Intellectual Property - Patentability of Computer Programmes - Exclusions

In the recent judgment of Re Shopalotto.com (2005), the Comptroller refused a patent application for a computer programme that permitted a user to play the lottery on the grounds that it was excluded from patentability under the provisions of the Patents Act 1977.

Shopalotto.com applied for a patent of a computer apparatus configured to provide a lottery playable via the Internet. The apparatus provided a web server and further software conditioning the machine to receive, store, select and compare. This enabled the computer to operate in a new wayto permit a user to play the lottery. The application was rejected and Shopalotto.com appealed this decision.

The patentability of the computer apparatus was examined in light of the exclusions under paragraph 1(2)(c) and (d) of the Patents Act 1977. These provisions exclude from being patentable, a scheme, rule or method of performing a mental act, playing a game, or doing business, and computer programmes and presentations of information.

Re Shopalotto.com argued that this claim was a game, conceptually no different from a board game, and therefore patentable as a result of a note from Official Ruling 1926(A) (1926) 43 RPC Appendix page i, which stated that a playing game would meet the requirements of an invention under s.93 of the Patent and Designs Acts, 1907 and 1919.

The Deputy Director of the Comptroller determined that the Official Ruling guidelines on the interpretation of the 1907 and 1919 Acts were not valid guidelines for interpreting the 1977 Act. Furthermore, as there have been difficulties in interpreting the 1977 Act, the court would refer to Article 52 of the European Patent Convention, which has the same effect as the 1977 Act.

The Deputy Director concluded that:-

▪ the first test to determine whether a computer programme is an invention is whether the inventor has contributed over and above a computer operating in a new way as a matter of substance;

▪ the second test is to determine whether the contribution lies in an excluded matter or, on the contrary, whether it creates a technical contribution or effect;

▪ in this case, it was unnecessary to make a search on the contribution to the art as computer programmes are notorious and the court could therefore apply common sense;

▪ the programme provides a web server to the Internet, which is a common service; and

▪ there is no contribution to the art outside of the provision of various pages to view the pages provided by the server.

The Deputy Director therefore dismissed the appeal.

With a script adapted from the British TV series Steptoe & Son, Sanford And Son highlighted the underrated talent of popular stand-up comedian Redd Foxx (prevented by segregation from becoming a superstar decades earlier). Created by Norman Lear, the brains behind such hits as All In The Family, the show signaled the emergence of a new class of sitcoms penned by the 1970s writer. Gladiator (DVD) Review

Reminiscent of Mel Gibson’s Braveheart, it creates a world so seemingly realistic, you find yourself drawn backward in time to the glory days of Rome. The musical score, colorful costumes, and intricate sets combine to create the illusion that one is actually witnessing the trials and travails of human existence in early millennial Rome.

The film opens with a sobering display of ancient warfare’s equivalent of “shock and awe” as the Roman legions advance on a band of rebels resisting the empire from the outskirts of Gaul. From the moment the legion commanders signal attack, the fury of hell is unleashed as flaming arrows and iron bars batter a unified front of rebel fighters. The scene is more comparable to Desert Storm than an ancient battlefield, and it visually illustrates the overwhelming power once embodied in the Roman legions.

The central figure of the film and leader of the opening battle is Maximus (Russell Crowe), a Roman general adored by his men and admired throughout the empire for his impeccable character. While visiting the battlefield, the aging Emperor Marcus Aurelius (Richard Harris) reveals to Maximus his secret plan to appoint the general caretaker of Rome upon his death, with the understanding he will restore the Senate and eliminate the dictatorial rule of the Caesars. But unbeknownst to both men, the emperor’s overly ambitious son Commodus (Joaquin Phoenix) learns of the plan. He murders his father and demands the allegiance of Maximus. When the general refuses, the new emperor calls for his execution, seeking to eliminate all who stand in his way. But the plan goes awry when Maximus escapes, setting the stage for the central conflict of the film as Maximus the gladiator grows in legend and Maximus the slave challenges the authority of a Roman emperor…

Crowe is cast well in the roll of the classic hero, but it’s the supporting cast which puts Gladiator in another dimension of cinematic excellence. Joaquin Phoenix dominates the screen with his impassioned portrayal of the darkly ambitious Commodus, providing film lovers with an early glimpse of his now apparent acting genius. Richard Harris is his usual charismatic onscreen presence, while Connie Nielsen, Oliver Reed, and Derek Jacobi lend excellent complimentary support to the role of Maximus as their characters unveil the driving life force and internal motivations of the larger than life Roman hero. To this end, the strength of the cast creates a synergy reflected in the overall quality of this memorable film.

As a work of entertainment, Gladiator is second to none. The gladiatorial battle scenes provide endless thrills, and the dialogue between the characters is wrought with political intrigue, lust for power, and conflicting realities. Russell Crowe is superb in his role as the hero Maximus. Noble in his intentions and powerful as a leader, Maximus represents the ideal of honor and chivalry. One of those rare films which offers its audience a true emotional stake in the outcome, Gladiator is fraught with high-octane suspense and thrilling action sequences.
